Premises Licence
Grant or Full Variation applications:-
· Application:- fixed fee of £650-
£1250 plus VAT (@20%) depending on the complexity of the case plus licensing authority fees (set by Government- based on premises rateable value- usually:- £100; £190; or £315 or higher (see www.gov.uk/government/publications/alcohol-licensing-fee-levels) plus
advertisement cost in a local newspaper (circa £280-350 plus VAT (@20%)). (Timeframe- minimum 1 month from the submission date for a grant without
objections).
· Contested
applications- further fees charged at an hourly rate of £250 plus vat (@20%); but on a case by case basis we will always try to agree a fixed fee with our client for preparing and attending
licensing authority hearings or court hearings. (Timeframe- decision from a licensing sub-committee hearing following representations to an application is usually made
within 2 months from the application submission date).
Transfer or DPS variation applications:-
· £150 plus VAT
(@20%)plus £23 licensing authority fees per application. (Timeframe- the application can take immediate effect on the application date).
Review of Premises Licence
· Charged at the
contested hourly rate of £250 plus VAT (@20%) or fixed fees to be agreed on a case by case basis. (Timeframe- a review hearing infront of a Licensing Committee is
usually within 8 weeks of the application date of the review application).
Legal Fees above include:
- taking your instructions- (in person, by email or by telephone);
- Advising on:- the licensing plan you need to provide to us (if required) (NB- we do not prepare licensing plans); the licensing fees payable to local authority;
- drafting operating schedule including our suggested Licensing Conditions to promote the Licensing Objectives (if applicable);
- drafting a consent form for the Designated Premises Supervisor (if applicable);
- Checking DPS’s right to work in UK (if applicable);
- completing and submitting the application, including the Operating Schedule (if applicable) and advising on how to promote the licensing objectives;
- drafting any required advertising notice or premises notice, arranging publication in an appropriate local newspaper;
- Advice on displaying the notice;
- Reporting to you on the outcome of the application.
Legal Fees above exclude:
- pre-consultation with Responsible Authorities or with the Licensing Authority or any other party prior to submitting the licensing application;
- Preparing or arranging the production of required Licensing plans;
- If there are any representations made against the granting of the application all our work at the end of the application representation period such as advising on representations received from
either the Responsible Authorities or other Interested Parties;
- attending site meetings or visiting the site;
- work dealing with/ negotiation with Responsible Authorities or Interested parties in relation to their representation(s), attending meetings or advising you in relation to such dealings; work
required preparing documentary evidence for a required Sub-Committee Licensing hearing; attendance and representation (our own advocacy) by us at Licensing Hearings, including preparing
evidence and taking witness statements and dealing with any other related matters;
- If required, the drafting additional documentation which maybe required to support the granting of the application;
- Expert fees (eg noise consultants) where deemed applicable (including our time instructing Experts);
- Instructing and thereafter liaising with Counsel (a Barrister) for opinions or representation at required Licensing Hearings;
- Checking:-property titles or Commercial leases (for alcohol restrictive covenants or anything else); planning consents or any planning work; neighboring property application searches (eg
for licensing, planning etc);
- All work post licensing hearings including advising on appeals and submitting any appeal documentation and any work associated with an appeal.
